  • OSHA Anti-Retaliation Rules Survive Challenge – Society for Human Resource Management: A Texas-based federal judge denied the injunction placed on the OSHA anti-retaliation provisions of the new electronic recordkeeping rule, allowing the first phase of the implementation to officially be put into effect on December 1, 2016, as scheduled. The judge’s decision was based on failure to prove that irreparable harm would result from the rule’s issuance.
  • OSHA Wants Public Assistance with Leading Indicators Guidance – The National Law Review: For the first time in organizational history, OSHA is asking for public insight on “leading indicators” for potential inclusion in their annual guidance cataloging measures for improving safety and health in the workplace. The change stems from past criticism that documenting “lagging indicators”, such as safety performance documents, does not provide guidance or actionable insights on how to prevent and control workplace injury fatality moving forward.

  • Cal/OSHA Cites Solar Panel Installer After Fall – Occupational Health & Safety: A California-based electric company is facing serious and willful safety violation following an employee’s 29 foot fall during the installation of solar panels. Totaling more than $130,000 in penalty fines, the issuance of these violations coincides with OSHA’s increased focus on fall prevention, the leading cause of death in the construction industry.
  • Complaint about Fall Hazards Results in OSHA Inspection – EHS Today: Following an unannounced visit to a Philadelphia construction site, a Pennsylvania contractor has been issued one repeat and one alleged serious violation pertaining to exposure to imminent danger fall and trenching hazards.
  • Masonry Contractor, Cited 41 Times Since 2011, Faces $345K Fine – Bloomberg BNA: A Pennsylvania-based masonry contractor is facing nearly $345,000 in fines, resulting from employee exposure to scaffolding hazards. Since 2011, the company has been issued 41 citations and in OSHA’s Severe Violator Enforcement Program.
